Ajax Empty object doesn't repopulate

Running server 8.5 and our users are connecting to the reports via AJAX. If they click on a selection and one of the objects (strait table) on the page doesn't have any values then the box shows empty. However, when you click clear it doesn't repopulate.

is this a known issue in 8.5 and does 9.0 fix it?
